Article 1 (General Provisions) These Terms of Service (these "Terms") set forth the conditions of use for the smartphone application "Birdie Care Log" (the "App") provided by the developer ("we," "us," or "our"). By using the App, you are deemed to have agreed to these Terms and our separately defined Privacy Policy.

Article 2 (Description of Services)

  1. The App provides features for users to record, manage, and obtain information related to the health of their pet birds.
  2. All information provided by the App's AI features (AI Summary Report, AI Chat, Emotion Analysis) is strictly for general informational and entertainment purposes and is not a substitute for medical diagnosis, treatment, or advice from a veterinarian.
  3. The free version of the App has limitations on certain features (e.g., number of birds that can be registered (up to 7), number of uses for AI features). Subscribing to the paid Premium Plan removes these limitations and hides advertisements.

Article 3 (Conditions of Use)

  1. The user is solely responsible for the accuracy of all information entered into the App (e.g., pet's health records, profile).
  2. The user shall use the App at their own risk and shall be solely responsible for all actions taken using the App and their results.

Article 4 (Prohibited Acts) Users shall not engage in any of the following acts:

  1. Acts that violate laws or public order and morals.
  2. Acts that infringe on the rights or interests of others.
  3. Acts such as modifying, reverse-engineering, decompiling, or disassembling the App.
  4. Unauthorized use of the App or unauthorized access to our servers.
  5. Assigning or lending an account to a third party.
  6. Registering false information.
  7. Any other acts that we deem inappropriate.

Article 5 (Subscription Agreement and Cancellation)

  1. The App offers an auto-renewing subscription service (the "Premium Plan") through the Apple App Store or Google Play Store.
  2. The price of the Premium Plan shall be the amount displayed in your local currency on the purchase screen within the App. Prices are subject to change depending on the region and currency.
  3. Payment will be charged to your Apple ID or Google Account upon confirmation of purchase.
  4. The subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  5. You can manage and cancel your subscription through your platform's (App Store or Google Play Store) account settings. Uninstalling the App will not cancel your subscription.
  6. Except as required by law, we do not provide refunds for cancellations made during a purchased subscription period.
  7. If you cancel your Premium Plan subscription, you will continue to have access to premium features until the end of your current billing period, after which your account will automatically revert to the free plan.

Article 6 (Use of Third-Party Services) The App uses third-party services provided by companies such as Google LLC to provide its features. The terms of service and privacy policies of these third parties apply to the use of their services.

Article 7 (Intellectual Property Rights) All copyrights and other intellectual property rights related to the App belong to us or to third parties who have granted us a license.

Article 8 (Suspension or Termination of Service) We may suspend or terminate the provision of the App, temporarily or permanently, without prior notice due to maintenance, system failure, or other unavoidable reasons.

Article 9 (Disclaimers of Warranties; Limitation of Liability)

  1. We do not guarantee the accuracy, completeness, or usefulness of the information provided by the App. In particular, the analysis results and suggestions generated by the AI features are reference information based on statistical estimates, and we shall not be liable for any damages arising from their inaccuracy.
  2. The user is strictly prohibited from making any decisions regarding their pet's health based solely on the information from this App and is obligated to consult a professional veterinarian. We shall not be liable for any damages incurred by the user or any third party as a result of using this App, except in cases of our willful misconduct or gross negligence.
  3. We shall not be liable for any damages arising from the inability to use the App, loss of data, or any other issues related to the App.

Article 10 (Governing Law and Jurisdiction) These Terms shall be governed by the laws of Japan. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.

Article 11 (Language) These Terms are provided in Japanese as the original version and may be translated into English for reference. In the event of any conflict or inconsistency between the Japanese and English versions, the Japanese version shall prevail.
