Birdie Care Log Privacy Policy

The developer ("we," "us," or "our") establishes the following privacy policy (this "Policy") regarding the handling of user information, including personal data, in the smartphone application "Birdie Care Log" (the "App").

This Policy complies with the Act on the Protection of Personal Information of Japan, as well as the requirements of the EU General Data Protection Regulation (GDPR) applicable to users residing in the European Economic Area (EEA).

Note on Voice Data: When recording bird calls for the emotion analysis feature, the user's (human) voice may be unintentionally recorded in the background. While the App does not use the user's voice for personal identification, such voice data could be considered "biometric data" under the GDPR. The processing of this data is also based on your explicit consent.

Article 3 (AI and Profiling)

The App's AI features (AI Summary Report, AI Chat, Emotion Analysis) automatically analyze health data and voice data you provide to infer health trends and estimate emotions. This may constitute "profiling" under the GDPR.

These AI-driven analyses are not a substitute for medical diagnosis by a veterinarian and do not constitute automated decision-making that produces legal effects concerning you or similarly significantly affects you. You have the right to object to the results of the AI analysis and provide feedback.

Article 4 (Disclosure to Third Parties and International Data Transfers)

Data Processors

To provide the features of this App, we use the following third-party services (data processors) and share your personal data with them as necessary. We have entered into data processing agreements with these processors.

International Data Transfers

Your personal data is processed and stored on servers in Japan. This constitutes a transfer of data outside the EEA where you may reside. This international data transfer is based on the European Commission's adequacy decision for Japan, which recognizes that Japan's personal information protection system provides an adequate level of data protection. If data is further re-transferred from Japan to a third country (e.g., Google's servers in the U.S.), it will be done so under appropriate safeguards, such as Standard Contractual Clauses (SCCs).

This Policy is provided in Japanese as the original version and may be translated into English for reference. In the event of any conflict or inconsistency between the Japanese and English versions, the Japanese version shall prevail.
